### The legal terms that apply to your use of cremationink.com and any order you place with us. Plain English, no surprises.

## Cremation Ink ® Terms And Conditions Of Sale

These terms apply to all transactions on this website. Please read them carefully. They do not affect your statutory rights as a consumer. By accessing this website or placing an order, you agree to be bound by these terms. If you do not agree, please don’t use the site.

## 1. About Us

This website (cremationink.com) is operated by Cremation Ink ®, a UK-based service that processes a small portion of cremation ashes and infuses them into professional tattoo ink for use in commemorative tattoos. Where these terms refer to “we,” “us” or “our,” they mean Cremation Ink ®, its officers, employees, agents and suppliers. Where they refer to “you” or “your,” they mean the visitor to the website or customer placing an order.

### 2. The Contract Between Us

A contract for the supply of goods through this website is formed when:

- You place an order through the website
- You make payment for the order in full (unless we have made a separate written arrangement with you)
- We accept your order and confirm by email

Before that point, no binding contract exists. We are entitled to decline or withdraw from any order in the case of obvious errors or inaccuracies regarding the goods described or priced on the website. If a pricing or description error is discovered, we will contact you as soon as possible by email and offer you the choice to proceed at the corrected price, or to cancel for a full refund.

Any term that you try to impose on the contract through your order does not form part of the contract. The contract is governed by these terms only.

### 3. General Terms

These terms, and all transactions relating to this website, are governed by the laws of England and Wales, and are subject to the non-exclusive jurisdiction of the English courts. We do not accept amendments to these terms unless specifically agreed in writing.

These terms cover only the cremationink.com website and any directly associated domains. Any third-party sites linked from cremationink.com are governed by their own terms, and we accept no responsibility or liability for the content or operation of websites that aren’t under our control.

Sales are concluded in English only.

### 4. This Website And Intellectual Property

All trademarks, copyright, designs, content, software, layouts, logos and other intellectual property on cremationink.com belong to Cremation Ink ® and are protected by UK and international intellectual property law. You may view, download and print pages from the site only for your own personal, non-commercial use. Any other use, reproduction, distribution, modification or republication is not permitted without our prior written consent.

You may not create any link to this website without our prior consent in writing, and you may not use the site in any way that restricts or inhibits use or enjoyment by anyone else.

We will use reasonable endeavours to verify the accuracy of information published on the site, but we make no warranties, express or implied, regarding accuracy, fitness for purpose, or that the site will be uninterrupted, timely or error-free. We will not be liable to you for any loss of content or material uploaded or transmitted through the site.

### 5. Payment

Payment is taken in full at the point of order, in pounds sterling (GBP), unless we have agreed otherwise with you in writing. We use third-party payment processors to handle transactions, and we do not store full payment card details on our own systems.

### 6. Your Loved One’s Ashes In Our Care

We treat the ashes entrusted to us with the highest respect and dignity at every stage.

When your kit arrives at our lab containing your loved one’s ashes:

- A unique reference is assigned to your order
- One technician is assigned to your order and handles the ashes from start to finish
- We do not process any other order’s ashes in parallel, so no cross-contamination can occur
- Any ashes that aren’t used in the infusion process are returned to you alongside the finished ink

While the ashes are in our care, we hold them as a bailee. We will take reasonable care of them, but we are not insurers. Our liability for loss or damage to ashes while in our possession is limited as set out in section 13.

You confirm, by sending us ashes, that you are legally entitled to do so (either as next of kin, executor, the named beneficiary under a will, or with the agreement of all parties so entitled). We rely on this confirmation and do not independently verify the chain of legal ownership.

### 7. Bespoke Made-To-Order Goods And Your Right To Cancel

Our tattoo ink is made specifically for you, with your loved one’s ashes, on a personalised basis. This means that under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the standard 14-day right to cancel does not apply to your order once we have begun processing your ashes.

Before we begin processing, you may cancel for a full refund. Please contact us as soon as possible if you change your mind.

Once your ashes have been received and processing has started, the goods are classed as bespoke and the right of cancellation no longer applies. Our [refund and returns policy](https://cremationink.com/refund-and-returns-policy/)
 continues to apply where the goods are defective or have been damaged in transit.

### 8. Delivery, Postage And Lost Or Damaged Items

We use tracked and signed-for postal services for both the outgoing kit and the return of your finished ink. Once an item is in the postal system, the postal service handles its onward delivery.

**If your finished ink doesn’t arrive:** Compensation for non-delivery will not be considered until 21 working days after we provide the tracking number. After 21 working days we will refund the price you paid us to process your loved one’s ashes. Any further claim against the postal service is the responsibility of the customer.

**If your kit goes back in the post without proper postage:** Don’t worry. Royal Mail and most international postal services do not destroy or dispose of underpaid mail. The package will either be returned to you with a postage-due note, or delivered to us with a postage charge we’ll cover. Either way, your loved one’s ashes are not lost. Contact us if you’re worried and we’ll keep an eye out for your parcel arriving.

**If your goods arrive damaged:** Please contact us within 7 days of delivery with photo evidence of the damage to both the packaging and the goods. We will assist you in making the claim with the postal service, and we will replace or refund on receipt of the photographic evidence.

You will be reimbursed only for the price of the product you ordered. We do not offer additional compensation for any disappointment, inconvenience or consequential loss.

**International orders and customs:** Customs duties, taxes and any clearance charges imposed by the destination country are the responsibility of the customer. We have no control over these charges and they are payable by the customer at the point of delivery.

### 9. Working Days

A working day is any day that is not a Saturday, Sunday or public holiday in England and Wales, unless a Saturday guaranteed delivery option has been purchased, in which case Saturday counts as a working day for that order.

### 10. Availability Of Goods

If for any reason we cannot complete your order in the agreed format, we will notify you as soon as possible. Any sum debited from your payment method will be re-credited to that same account, and we will notify you by email at the address you gave in your order. Refunds are made as soon as possible and in any case within 30 days. We are not obliged to offer any additional compensation for disappointment.

### 11. Storage And Shelf Life Of The Ink

Cremation Ink ® is a bespoke tattoo ink with a defined shelf life. The figures below apply to all bottles supplied:

**Sealed (unopened) shelf life: up to 12 months from the date of dispatch**, provided the bottle is stored correctly. Correct storage means cool, dry, dark conditions. A standard household fridge (typically 2-5°C) is ideal. A cool, dry cupboard out of direct sunlight is acceptable. Hot environments (such as a car in summer, a windowsill, or anywhere subject to temperature swings) are not acceptable and will reduce shelf life.

**Opened shelf life: 6 months from the date the seal is broken.** Once a bottle has been opened by you or your tattoo artist, the ink should be used within six months. After six months, the ink should not be used and should be safely disposed of.

If the bottle is not stored as set out above, or is used after the stated shelf life, the product is no longer under our quality guarantee and any claim relating to product quality, behaviour or safety will not be considered.

You agree to:

- Store the bottle correctly from the moment of delivery
- Not use a bottle that has been damaged, seal-broken in transit, or shows signs of contamination, separation that doesn’t resettle with gentle shaking, discolouration, or any other visible abnormality
- Not use a bottle after the stated shelf life
- Not refill, dilute, decant, or add anything to the bottle before or during use, beyond the standard practice of pouring the ink into a tattoo artist’s ink pot at the time of tattooing

### 12. The Tattoo Itself Is Between You And Your Artist

Cremation Ink ® supplies a tattoo ink. We do not supply the tattoo.

The decision to be tattooed, the choice of tattoo artist, the choice of design, the application of the tattoo, and the aftercare of the tattoo are all the responsibility of you and your chosen tattoo artist.

Specifically, Cremation Ink ® is not liable for:

- The quality of the tattoo as applied by your artist
- The skill or experience of the tattoo artist you choose
- Any healing complications including but not limited to scabbing, ink rejection, scarring, raised areas, itchiness, fading, or skin reactions
- Any infection at or near the tattoo site
- The studio’s hygiene, equipment or procedures
- Decisions you or your artist make about aftercare, including the use or non-use of recommended aftercare products
- Your choices during the healing period, including but not limited to swimming, sunbathing, picking, scratching, or otherwise disturbing the healing tattoo
- Any advice given to you by your artist, by friends and family, or by online sources, that conflicts with sensible aftercare

A tattoo is a personal decision and carries normal tattooing risks that exist for every tattoo, whether done with our ink or any other quality professional ink. By placing an order with us, you confirm that you understand and accept these standard risks.

If you have concerns about a healing tattoo, please speak to your tattoo artist first, and your GP if symptoms suggest infection or any other medical issue. Cremation Ink ® is not able to give medical or aftercare advice about your specific tattoo, because we don’t see the tattoo, the studio, or the healing process. The artist who did the tattoo is the right person to support you.

### 13. Limitation Of Liability

Nothing in these terms limits or excludes our liability for:

- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Defective products under the Consumer Protection Act 1987
- Any other liability that cannot be limited or excluded under English law

Subject to the above, our total liability to you, whether in contract, tort, negligence or otherwise, in connection with any order or these terms, will not exceed the price you paid for the goods in question.

We are not liable to you for any indirect, consequential or special loss, including loss of profits, loss of business, loss of opportunity, loss of data, or loss of enjoyment.

Our liability for the product covers the ink as supplied by us, in the condition it leaves our premises, within the stated storage and shelf-life conditions in section 11. Once the bottle is in your hands or your artist’s hands, the use of the ink, the storage of the ink, and the tattoo done with the ink are matters for you and your artist, and section 12 sets out the position there.

### 14. Disputes And Governing Law

If you have a complaint or a concern, please contact us first so we can try to put it right. Most disputes are resolved through informal communication.

These terms and any contract formed under them are governed by the laws of England and Wales. Any dispute or claim arising out of or in connection with these terms or any contract is subject to the non-exclusive jurisdiction of the courts of England and Wales.

Consumer rights under UK law are not affected by these terms.

### 15. General Legal Points

If any clause of these terms is held to be unenforceable, that clause will be severed and the remaining terms will continue in full force.

Our failure to enforce a right under these terms does not prevent us from enforcing other rights, or the same right on a later occasion.

You may not assign or transfer any of your rights or obligations under these terms without our prior written consent.

Nothing in these terms confers any right on a third party under the Contracts (Rights of Third Parties) Act 1999, but this does not affect any right or remedy that a third party has or has access to apart from that Act.

, are the entire agreement between us and supersede any prior understanding, written or oral.
